1. Acceptance of Terms

By accessing and using NextStep SA ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. These terms constitute a legally binding agreement between you and NextStep SA.

2. Eligibility

You must be at least 18 years old to use this platform. By using NextStep SA, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms of Service.

3. User Accounts

3.1 Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Types

We offer two types of accounts: Job Seeker accounts and Employer accounts. Each account type has different features and responsibilities as outlined in these terms.

4. User Responsibilities

4.1 Job Seekers

Job seekers agree to:

  • Provide truthful and accurate information in their profiles and CVs
  • Keep their information up to date
  • Not misrepresent their qualifications or experience
  • Respond professionally to employer inquiries
  • Not use the platform for any fraudulent purposes

4.2 Employers

Employers agree to:

  • Provide accurate company information
  • Use candidate information only for legitimate recruitment purposes
  • Comply with South African employment laws and regulations
  • Not discriminate based on race, gender, age, or other protected characteristics
  • Maintain confidentiality of candidate information
  • Pay subscription fees as agreed

5. Prohibited Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or viruses
  • Harass, abuse, or harm other users
  • Scrape or collect data from the platform without permission
  • Create multiple accounts to circumvent restrictions
  • Use the platform for spam or unsolicited communications
  • Impersonate another person or entity
  • Interfere with the proper functioning of the platform

6. Pricing and Payment

6.1 Subscription Plans

Employer accounts require paid subscriptions as outlined on our Pricing page. Job seeker accounts may have free and paid tiers with different features.

6.2 Payment Terms

Subscription fees are billed in advance on a monthly basis. All fees are in South African Rand (ZAR) and are non-refundable except as required by law.

6.3 Price Changes

We reserve the right to change our pricing at any time. We will provide notice of price changes and you will have the opportunity to cancel your subscription before the new prices take effect.

7. Intellectual Property

The platform and its original content, features, and functionality are owned by NextStep SA and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you submit, but grant us a license to use, display, and distribute it as necessary to provide our services.

8. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, secure, or error-free. We do not verify the accuracy of user-submitted information and are not responsible for employment decisions made based on information found on the platform.

9. Limitation of Liability

To the maximum extent permitted by law, NextStep SA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.

10. Indemnification

You agree to indemnify and hold harmless NextStep SA and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform or violation of these Terms of Service.

11. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms of Service. You may also terminate your account at any time by contacting us. Upon termination, your right to use the platform will immediately cease.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the platform after changes constitutes acceptance of the new terms.
